FortyxIn short: Fortyx VPN encrypts the connection between your device and a server you choose, and filters out advertising domains along the way. There is no account. Subscriptions are billed by Apple and renew automatically until cancelled. A VPN is for lawful use and does not make anything legal that would otherwise not be.
1. Who we are
Fortyx VPN (the “App”) is published by LEADPIXEL LABS LLC, 30 N Gould St, Sheridan, Wyoming 82801-6317, United States (“we”, “us”, “our”). You can reach us at support@fortyx-vpn.com.
2. Accepting these terms
These Terms of Use form a binding agreement between you and us and govern your use of the App. By downloading, installing or using the App, you confirm that you have read and accepted them. If you do not agree, do not use the App and delete it from your device.
These terms apply in addition to Apple's own terms for the App Store, which govern your relationship with Apple as distributor.
3. Licence
We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to install and use the App on Apple-branded devices that you own or control, in accordance with the Apple Media Services Terms and Conditions. The App is licensed to you, not sold.
You may not sublicense, rent, lease, sell or redistribute the App, resell access to the service, or use it to build a competing product.
4. Eligibility
You must be at least 16 years old, or the minimum age required where you live, to use the App. If you are under the age of majority in your jurisdiction, you may use the App only with the involvement of a parent or guardian who accepts these terms on your behalf.
5. What the service is
The App establishes an encrypted tunnel between your device and one of our servers, using the VPN facilities that iOS provides, and applies domain filtering to the traffic passing through it.
What a VPN does not do, and what we do not claim it does:
- It does not make you anonymous. Services can still identify you through accounts you sign into, cookies already on your device, browser fingerprinting, and anything you submit yourself.
- It does not encrypt traffic beyond the server it exits from. From there onwards, traffic travels as it normally would.
- It is not antivirus software, malware protection or a firewall.
- It does not guarantee access to any particular website or service, and does not guarantee any particular connection speed.
- Server locations, capacity and availability change over time. The list shown in the App is the current one; no specific location is guaranteed to remain available.
6. Ad filtering
The App can block requests to domains known to serve advertising or tracking. Filtering is applied from a blocklist that is the same for every user.
Blocklists are inherently imperfect. A domain may be blocked that a site depends on, in which case that site may behave unexpectedly; equally, some advertising will get through. Filtering can be switched off in the App at any time, and this does not affect the encrypted connection. We do not warrant that any particular advertisement, tracker or domain will be blocked.
7. Acceptable use
You agree not to use the App to:
- break any law that applies to you;
- send spam, run denial-of-service attacks, scan or intrude into systems you do not control, or distribute malware;
- infringe intellectual property rights;
- transmit material that sexually exploits children, incites violence, or facilitates harassment or fraud;
- interfere with the service, circumvent usage or subscription controls, or obtain paid features without payment;
- reverse engineer, decompile or disassemble the App, except where that restriction is prohibited by applicable law.
We may suspend or terminate access where we have a reasonable basis to believe the service is being used in these ways.
8. Local law
VPN use is restricted or regulated in some countries. You are responsible for knowing and complying with the law where you are. Using the App does not change what is lawful for you to do, and we make no representation that the App may lawfully be used in any particular country.
9. Subscriptions and payment
Paid features are offered through an auto-renewing subscription. Current prices are shown in the App and on the App Store in your local currency before you confirm a purchase.

10. Refunds
Purchases are processed by Apple and refunds are handled by Apple under the Apple Media Services Terms and Conditions. We cannot issue refunds directly. Requests go through reportaproblem.apple.com. If something is not working as described, write to us first — we would rather fix it.
11. Right of withdrawal
If you are a consumer in the EU or EEA, you normally have 14 days to withdraw from a distance contract for digital content. By starting to use paid features immediately after purchase you request immediate performance and acknowledge that you lose that right once performance has begun, to the extent permitted by law. This does not affect your statutory rights in respect of faulty digital content.
12. Intellectual property
The App, its name, logo, interface, code and design are owned by us or our licensors and are protected by intellectual property law. Nothing in these terms transfers any of those rights to you.
Fortyx VPN is not affiliated with, endorsed by or sponsored by Apple Inc. Apple, iPhone, iPad, iOS and App Store are trademarks of Apple Inc.
13. Disclaimers
The App is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
We do not warrant uninterrupted or error-free operation. Networks fail, servers are taken out of service for maintenance, and connection quality depends on your own internet connection and on factors outside our control. Nothing here limits liability that cannot be limited under the law that applies to you as a consumer.
14. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or for loss of profits or data, where that loss was not reasonably foreseeable or arose from circumstances outside our control.
Where liability cannot be excluded, our total liability is limited to the greater of the amount you paid for the App in the 12 months preceding the event, or USD 50.
15. Termination
You may stop using the App and delete it at any time. We may suspend or end your licence if you materially breach these terms, or if we discontinue the App. Any active subscription remains governed by Apple's terms until it expires or is cancelled.
16. Apple-specific terms
The following applies because the App is distributed through the App Store:
- This agreement is between you and us only, not with Apple. We, not Apple, are solely responsible for the App and its content.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- We, not Apple, are responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to a legal requirement, and claims arising under consumer protection or privacy legislation.
- We, not Apple, are responsible for investigating and resolving any third-party claim that the App infringes intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.
17. Changes
We may update these terms as the App changes or the law requires. The updated version is posted on this page. Material changes will be signalled in the App. Continuing to use the App after a change means you accept the updated terms.
18. Governing law
These terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-laws rules. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may bring proceedings in your local courts.
